1. Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this Promotion is deemed acceptance of these Terms and Conditions.

    

2. The Promoter is Loyalty Results Pty Ltd (ABN 72 648 480 004), 8/8 Trawalla Avenue, Toorak VIC 3142 Telephone: 0418 320 425 (“Promoter“).

    

3. Entry is open to all Australian residents (excluding ACT) aged 18 years or over who hold a current Australian Business Number (ABN) or are an authorised represent of a business who holds a current ABN, and who is invited by Promoter to enter the promotion (“Eligible Entrants“).

    

4. Employees (and their immediate families) of the Promoter and agencies associated with this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grand-parent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st Cousin
   
5. Entries into the Promotion open on 29/06/22 and close at 11:59PM AEST on 19/05/23 (“Promotional Period”).

    

6. To be eligible to enter, Eligible Entrants must, during the Promotional Period:

• Visit instaprize.com.au OR scan the promotional QR code provided by the Promoter;
• Follow the prompts to and click the button directing “play the game”; and then
• Play the online game (the “Game”) whereby Eligible Entrants will be required to either scratch or click an icon on the screen as directed. Upon completing this action, Eligible Entrants will reveal whether or not they have won an instant win prize. For clarity, Eligible Entrants must follow the prompts and keep the Game open on their device in order to successfully complete the Game. If the Game is not completed correctly, the attempt will be considered void and no prize will be awarded.

Upon completing the Game, Eligible Entrants must enter their details as prompted on screen. Eligible Entrants will be notified instantly in writing on-screen if they have won an instant prize. For clarity, all Eligible Entrants who input their details will be entered into the draw, regardless of if they have won an instant prize or not.

7. The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an Eligible Entrant’s identity) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

    

8. Incomplete or indecipherable entries will be deemed invalid.

    

9. If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Entrant.

    

10. Limit of one (1) entry per Eligible Entrant.

     

11. There are a total of fifty (50) instant prizes available in this promotion. Each instant prize is a Woolworths gift card valued at $10.

     

12. Any ancillary costs associated with redeeming a gift card are not included. Any unused balance of a gift card will not be awarded as cash.  Redemption of a gift card is subject to any terms and conditions of the issuer including those specified on the gift card.

     

13. The draw will take place at Loyalty Results Pty Ltd, 8/8 Trawalla Avenue, Toorak VIC 3142 on 26/05/23 at 12:30pm AEST. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. Winners will be notified by telephone and via email and will be published at instaprize.com.au from 30/05/23.

     

14. The first valid entry drawn in the draw will win that Eligible Entrant (“Participant“) the opportunity to each play a contingency game (the “Game“) for the chance to win $5,000.

     

15. The Game will take place at Loyalty Results Pty Ltd, 8/8 Trawalla Avenue, Toorak VIC 3142 on 02/06/23 at 12:30pm AEST. Any and all costs associated with attending the Game are the sole responsibility of the Participant. If the Participant resides more than 50km from where the Game is taking place, the Participant may participate in the Game via telephone or a video call whereby they will select a number between 1 and 50 (inclusive) and a representative of the Promoter will select the envelope (“Game Piece”) bearing that number on their behalf. If the drawn Participant resides in Victoria but cannot attend the Game, the Participant may appoint a proxy over 18 years of age to play the Game on his/her behalf provided the Participant gives the Promoter written, signed notice to that effect before the start of the Game. In the event that the Promoter has not been able to contact the Participant before the start of the Game, a representative of the Promoter will play the Game on the Participant’s behalf.

     

16. There will be fifty (50) numbered envelopes (“game pieces”) on display at the start of the Game. One (1) game piece will contain a promotional message representing $5,000 (“Major Prize”). The other forty-nine (49) game pieces will each contain a promotional message representing the Consolation Major Prize. The Participant/representative (“Attendee”) must choose only one (1) game piece without touching, handling or interfering in any way with any of the other game pieces on display. If the Attendee is found to have breached this condition, he/she will be disqualified. If the Attendee selects the game piece containing the promotional message representing $5,000, then, subject to verification by the judges, the drawn Participant will win $5,000. If the Attendee selects a game piece containing a promotional message representing the Consolation Major Prize, then the $5,000 prize will not be given away and, subject to verification by the judges, the drawn Participant will win the Consolation Major Prize of $500 (“Consolation Major Prize”). The Consolation Major Prize will be awarded on the day of the Game and the cash element of the prize will be awarded in the form of a cheque made payable in the winner’sname, alternatively this prize can be EFT (Electronic Funds Transfer) into the participants nominated bank account.

     

17. Winners are responsible for ensuring and checking the accuracy of the bank details provided and the Promoter is not responsible for any errors that are a result of the winners providing the incorrect details. The Promoter will not be responsible for banking institutions rejecting an EFT payment, or any costs associated with locating any lost prizes. Not providing bank details by the date requested by Promoter may result in prize payments being delayed. The Promoter is not responsible for any payments that have been successfully transferred into an incorrect nominated bank account. In these cases, there will be no further payments made.

     

18. The drawn Participant’s odds of winning the $5,000 prize is 1 in 50. The odds of being drawn as a Participant may be significantly higher than the odds of the drawn Participant winning the $5,000 prize and will depend upon the number of entries received.

     

19. The Game will be supervised by a representative from Anisimoff Legal, Level 3/162 Collins Street, Melbourne VIC 3000.

     

20. The Promoter’s decision is final, and no correspondence will be entered into.

     

21. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize at the time stipulated by the Promoter, then the prize will be forfeited.

     

22. Prizes, or any unused portion of a prize, are not transferable or exchangeable. If a prize is not won, claimed, taken or redeemed by the time specified by the Promoter and as outlined herein, the prize will be forfeited.

     

23. If a prize is unavailable for any reason, the Promoter reserves the right to substitute another prize of equal or greater value and specification for that prize, subject to any directions from a regulatory authority.

     

24. Total potential prize pool value is up to $5,500.

     

25. A draw for any unclaimed prizes in the draw may take place on 28/08/23 at the same time and place as the original draw, subject to any directions from a regulatory authority. In the event the draw prize is unclaimed and must be awarded in the unclaimed prize draw, the Game will still take place as scheduled, and the drawn unclaimed prize draw winner will be the Participant and will win the prize determined as a result of the Game. The Participant of the unclaimed prize draw will be notified by phone and email within two (2) business days of the draw. The Participant’s names will be published online at instaprize.com.au from 30/08/23.

     

26. Eligible Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

     

27. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to pandemic, technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.

     

28. Any cost associated with accessing the promotional website is the Eligible Entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted on behalf of that entrant invalid.

     

29. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.

     

30. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Eligible Entrant; or (f) use of a prize.

     

31. The Promoter collects personal information (“PI“) in order to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use, and handle PI as set out in its Privacy Policy, which can be viewed at [INSERT URL]. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Eligible Entrant. The Privacy Policy also contains information about how Eligible Entrants may opt out, access, update or correct their PI, how Eligible Entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose Eligible Entrant’s personal information to any entity outside of Australia.
